Terms of Service
These Terms govern use of CONSELA by an individual or organization (“you”). CONSELA is provided by Daniel Rossi Marinho - Unipessoal Lda, VAT/NIPC PT519202120 / 519202120. Full legal information and contact details are available on our Legal Information page.
1. The Service
CONSELA provides an AI-assisted workspace for research, structured advisory discussions and decision documents. It is not a law firm, accounting firm, investment adviser, medical provider or other professional adviser.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract. You are responsible for accurate registration information, protecting credentials, authorized use of your account and activity in your organization. Do not share credentials or allow access beyond the permissions you administer.
3. Organizations and customer content
You retain rights in prompts, files and other content you submit (“Customer Content”). You grant CONSELA a limited, worldwide, non-exclusive license to host, reproduce, transmit, transform and display Customer Content only as needed to provide, secure and maintain the Service as described in the Privacy Policy. We will not use Customer Content to train general-purpose models unless you separately agree in writing. You represent that you have the rights and permissions required to submit it and that it does not violate law or third-party rights. Organization administrators control member access and may be able to view or remove workspace content.
4. AI output
Reports, transcripts, research summaries and consensus documents are generated with automated systems and may be incorrect, incomplete, biased, stale or based on sources that later change. You must independently verify material information and decisions. Output is advisory material and not professional advice. See the AI Disclosure.
5. Acceptable use
You must not use the Service unlawfully; upload data without authorization; infringe rights; attempt to access another tenant; evade usage limits; introduce malware; interfere with the Service; use output as the sole basis for consequential decisions about people; or reverse engineer, resell or copy the Service except as permitted by law. 6. Plans, trial and credits
CONSELA currently offers Go at $20/month, Plus at $50/month, Pro at $150/month and Max at $500/month, in USD. Plans include 200, 500, 1,500 and 5,000 monthly research credits respectively. A 30-day trial provides 200 credits without requiring a payment method. Trial access ends unless you select a paid plan. Credits are usage allowances, not money, are non-transferable and reset monthly unless the checkout page says otherwise. The pricing and billing pages are part of these Terms for the applicable purchase.
7. Billing, cancellation and refunds
Paid subscriptions renew monthly until cancelled. Stripe processes payments and provides the billing portal. You may cancel through that portal; cancellation stops future renewal and access normally continues until the paid period ends. Prices are shown in USD and advertised prices include VAT where applicable; tax treatment is calculated at checkout. CONSELA does not offer voluntary refunds beyond refunds, cancellation rights, withdrawal rights, conformity remedies and other protections required by applicable law. Consumers retain all mandatory rights under applicable law, including EU digital-content and digital-service protections. Where performance begins during a statutory withdrawal period, you request immediate performance and acknowledge any consequences permitted by law.
8. Availability and changes
We may change, suspend or discontinue features for security, legal, technical or business reasons. We will give reasonable notice of material paid-plan changes where required. We do not guarantee uninterrupted availability or that every external research source remains accessible.
9. Confidentiality and security
We will handle Customer Content as described in the Privacy Policy and any applicable DPA. You should not submit information that you are prohibited from sharing or that requires security controls we do not provide.
10. Suspension and termination
We may restrict or terminate access for non-payment, security threats, unlawful use, rights violations or material breach. Where practical, we will explain the reason and provide an opportunity to remedy it. On termination, your deletion and export rights remain subject to the Privacy Policy, legal retention and backup schedules.
11. Copyright complaints
Copyright complaints and counter-notices may be sent through the process at Copyright and Content Complaints. We may terminate repeat infringers where appropriate.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim warranties not legally capable of being excluded. We do not warrant that output is accurate, complete, suitable for a particular decision or free from interruption.
13. Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss. CONSELA’s aggregate liability will be limited to the fees you paid for the Service during the 12 months before the event giving rise to the claim, or $100 if you paid no fees. These limits do not exclude liability that cannot legally be excluded, including fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
14. Disputes and governing law
These Terms are governed by Portuguese law. Disputes are subject to the competent courts of Portugal, except that consumers may bring claims before courts available under the mandatory law of their habitual residence and retain all non-waivable consumer protections.
